Klient hadde solgt sin lansbrukseiendom, men holdt tilbake en Setereiendom som skulle fradeles. Søknad om fradeling ble avslått av kommunen. Klient krevde da at kjøper av landbrukseiendommen måtte betale et tilleggsvederlag for Setereiendommen, ettersom den også ville følge med landbrukseiendommen grunnet fradelingsnekt. Kjøper av landbrukseiendommen ble dømt til å betale et tilleggsvedrelag til klient. Saken ble løst i tingretten.
